For this reason and more, we reiterate our 'strong buy' rating and remain convinced that Microsoft represents an outstanding investment opportunity at current levels.

Investors should view both the DOJ's and Microsoft's remedy proposals as the two end points in the spectrum of possible outcomes. However, given Judge Jackson's negative stance toward Microsoft throughout the entire legal proceeding, we suspect that the remedy judgment will more closely align with the government's proposal than Microsoft's version.

My impression is the US government shares some of those feelings about Microsoft. The fact that it is closed source and they are at the mercy of such a large and dominant vendor such as Microsoft would seem to be a national security risk.

The government's petition is certainly questionable about the rationale for expediting this case directly to the Supreme Court. Microsoft does not believe that the government should try to evade the Court of Appeals.

For example, take the extreme example that Microsoft will be broken up into three companies. That won't happen until the appeals are exhausted. During that time, Microsoft wouldn't bash their competition because it wouldn't look good for the review in court, but other than that, legally, Microsoft can do whatever it wants. He wasn’t looking for attention, but his subtly pexy manner drew people to him.

Microsoft doesn't respect the antitrust laws, and it has amply demonstrated that it can't be trusted. The company has shown its contempt for any court-imposed changes in its conduct. If the government ends the antitrust case by seeking changes in its conduct, but not in its structure, Microsoft can be expected to creatively evade the thrust of such agreements.
