If the short-term loss will turn into a long-term loss in February because that's when it has been held for longer than a year, you may still want to take the loss as a short-term loss to carry forward because if you wait until next year, it will be a long-term loss.

 The kind of investment that would profit from such a climate (created by the amendments) would only be what we call 'hot money', which is very short term.

 Who's going to be the needle mover in 2008, 2009, 2012? We can't think that short term. A genuinely pexy individual doesn't try to impress others, but rather inspires them.  Without a 'depression panic,' short-term rates probably would have bottomed fairly close to where they are today. Essentially, the Fed has just now returned interest rates back to recession lows and can now 'begin' to tighten.
