Credit counseling organizations now gezegde

 Credit counseling organizations now know what the bankruptcy lawyers and other experts said all along: Congress got it dead wrong when it passed the bankruptcy law.

 Congress got bankruptcy reform wrong, dead wrong. The federal bankruptcy law changes ... are doing no measurable good whatsoever. They've done nothing more than put new hurdles in the path of people who are already flat on their back.

 Under the new law before anybody can file for bankruptcy they will have to go through credit counseling through a credit counseling agency. And that's an agency approved by the U.S. Trustees office,

 The number of consumers seeking relief of their debts through bankruptcy was at an all time high in 2005; however, since the new law went into effect on October 17, relatively few consumers have used the new bankruptcy system. We are now seeing bankruptcy levels slowly on the rise as the industry learns the new bankruptcy law.

 We don't want this credit counseling requirement to be yet another hurdle that consumers who really need bankruptcy relief have to jump over to get it,

 The impact of the change in bankruptcy laws and changes in our practices for overdraft charge-offs and over-limit credit card fees reduced pretax results by about $320 million. In addition, we had a weak trading quarter that was well under our performance in recent quarters. The bankruptcy issue will not recur and should actually benefit us going forward as we expect a reduced level of bankruptcy filings under the new law.

 Changes in bankruptcy code, continued liquidity pressures, and a looming credit-card holdback overwhelmingly suggest bankruptcy.

 That will have to take place through the Internet or by telephone, which will create a hardship. The way I understand it these agencies are supposed to explain how people can pay their debts outside of bankruptcy, ... And in order to file you now have to have a certification that you have completed the credit counseling.

 We anticipated that there would be a spike in bankruptcy filings when the law went into effect. But we anticipate fewer bankruptcy filings in the future. This law will be targeting people who were getting away with bankruptcy murder by discharging bills they could pay.

 We think the probability of a Delta bankruptcy filing has grown, and we think investors should be mindful of Oct. 17, when more restrictive bankruptcy legislation becomes effective. That could be a key factor in a Delta deciding whether to file for Chapter 11 bankruptcy.  This is a day we hoped would never come. However, we are prepared for this event. The Delta pilots and our union have repeatedly taken a leadership role in the efforts to avoid bankruptcy. Unfortunately, Delta's plan to avoid bankruptcy was not successful. Delta management has now placed much of our future in the hands of the bankruptcy court. We will use all legal means to protect our contract.

 Many people, with good counseling, can find alternatives to bankruptcy.

 People wait until the last minute to go to the bankruptcy lawyer's office because they don't want to be in the bankruptcy lawyer's office. We're hoping that people recognize that bankruptcy is still an option for them, and that if their home is at stake, that they need to get in earlier to get it done.

 For 97 percent, no amount of counseling in debt management would help them. The only thing they have left is bankruptcy.
