 I think we're going to have a case that's largely about accounting allegations...where the government is going to refuse to call either David Duncan, who was the chief engagement partner for Arthur Andersen, or Rick Causey.

 Does David Duncan establish there was a crime? ... Absolutely, unequivocally, without a doubt, no. Are those the words of Rusty Hardin? No, those are the words of David Duncan.

 The government has tried to develop and present what I would call a second case -- that is a vague series of allegations that Microsoft is trying to gain a chokehold on the Internet,

 Rick Causey did this for one reason only and that was to protect his family.

 [Hardin Wednesday repeatedly tried to show that the government pressured Duncan to plead. At one point, Hardin pointed to prosecutors sitting to one side of the room.] The real hammer in this case is held at this table, ... It's the prosecutors who will recommend if Duncan will get probation or serve no time.

 Real people denied under oath that Duncan ordered a massive destruction of Enron documents. David Duncan did nothing criminal.
