 Any effort to improve relations between the Executive Branch and the members of the Supreme Court must be undertaken with extreme care to ensure that there is no appearance of an effort to affect the deliberations or decisions of the Justices, ... The dignity of the Court must also be maintained, and the Justices should under no circumstances be made to feel that they are being used as part of any political campaign or an effort to achieve any political end.

 It is clear that this illegal program violates our Constitution and laws governing surveillance. The president's false choice between securing our nation and preserving our Constitution must be rejected. Congress has an obligation to determine the truth, especially since the administration is unwilling to check itself. Hearings like this help ensure steps are taken so the rule of law is respected by all, even the president.

 In other words, liberal presidents appoint liberal justices who continue to take liberal positions for a while. Ditto for conservatives. But as new issues come to the Court, or as the justice for whatever reason makes adjustments in his or her political outlook, the president's influence wanes.

 President Bush's disregard and disrespect for the Constitution are evident, but in America, we are all bound by the rule of law. The president took an oath to 'preserve, protect and defend the constitution of the United States.' He cannot use a claim of seeking to preserve our nation to undermine the rules that serve as our foundation. The Attorney General, who may have been involved with the formulation of this policy, must appoint an outside special counsel to let justice be served.

 Throughout his years on the nation's high court, Chief Justice Rehnquist stood as a beacon of judicial restraint and reverence for the Constitution and the institution of the Supreme Court. I believe Judge Roberts will follow the lead of his mentor, and guide our nation's highest court by those same principles and devotion to the rule of law for all,

 the president and the vice president tried to use our Constitution and the amendment of that Constitution as a political tool, and the United States Senate, they said, 'No. We will not accept it.'

 Somebody asked me, 'are you going to be on the side of the little guy?' And you obviously want to give an immediate answer. But as you reflect on it, if the Constitution says that the little guy should win, the little guy is going to win in court before me. But, if the Constitution says that the big guy should win, well, the big guy is going to win, because my obligation is to the Constitution. That's the oath. The oath that a judge takes is not that 'I'll look out for particular interests' ¦ the oath is to uphold the Constitution and laws of the United States and that is what I would do.

 We have a remarkable political system, remarkable for its protection of liberty, its stability and for providing the basis for our economic well-being, ... The success of our political system is due, in large part, but not exclusively so, to the Constitution, now in place for over two centuries. We have been seduced by the great success of the Constitution and its political system, taking both for granted. We need to show more gratitude for the good things that come our way.

 The focus will soon shift to President Bush's next appointee to the high court. We have no doubt that President Bush will select a nominee who embraces his judicial philosophy of interpreting the Constitution - not legislating from the bench. The political dynamics suggest that the confirmation process for the next nominee will be much more contentious. We hope that isn't the case, but are certainly prepared to move quickly and aggressively to ensure that the next nominee gets a fair hearing and a prompt vote in the Senate.
