This is an unusual turn of events for the Justice Department to come out against the Fourth Circuit like this, because anybody who looks at precedent would see the Fourth Circuit is a very pro-government circuit that generally finds in favor of the government. |
Now we can go to court and challenge the government's assertion. |

We are anxious for the Supreme Court to hear the Padilla case and hope that this decision by the 4th Circuit will give the impetus for the Supreme Court to hear it. The executive use of authority has been overreaching in the domestic arena. |
