 I cannot support the Patriot Act conference report because it does not secure the right balance between our national security and civil liberties. As we protect and defend the American people, we must remain vigilant in protecting law-abiding American citizens from unaccountable governmental intrusion over their personal records. ...  We have a duty to protect the American people from terrorism, but also to protect law-abiding American citizens from unaccountable and unchallengeable government power over their personal lives, their personal records and their thoughts,

 Law-abiding Americans deserve to know that their government will not secretly tap their phones, read their medical records, access their library accounts or otherwise invade their personal lives, with no oversight or accountability. Law-abiding Americans also deserve to know that when law enforcement can show an impartial judge clear evidence of criminal activity or a threat to national security, swift and decisive action will be taken to protect the public. That is the balance we must achieve.

 The modified provisions will provide for the protection of civil liberties of United States citizens while permitting the federal government to continue investigating terrorists and protecting U.S. national security.

 The Patriot Act debate has come a long way, but there is still more that needs to be done to protect the rights of ordinary Americans. It is clear that there is building skepticism about the administration's approach to national security and civil liberties, and the ACLU and its bipartisan allies will continue to speak out in defense of all Americans' fundamental civil liberties and constitutional rights.

I would expect the government to say that it is highly sensitive material, but we have legal mechanisms to balance the national security needs with the rights of defendants. I think judges are very conscientious about trying to sort out these issues and balance civil liberties and national security.
